District Consumer Disputes Redressal Commission (DCDRC) – District Forum

The District Consumer Disputes Redressal Commission (DCDRC), commonly known as the District Forum, is the first level of consumer dispute resolution under the Consumer Protection Act, 2019. It handles consumer complaints at the district level to provide quick and efficient redressal of grievances.

Composition of District Forum

  • President: A District Judge (serving or retired).
  • Two members, including one woman.

Jurisdiction of District Forum

  • Monetary Jurisdiction: Handles cases where the claim amount does not exceed ₹1 crore.
  • Territorial Jurisdiction: Complaints can be filed where:
    • The opposite party resides or carries on business.
    • The cause of action (the event leading to the complaint) occurred.

Functions of District Forum

  1. Accepts consumer complaints related to defective goods, deficient services, unfair trade practices, and overcharging.
  2. Examines evidence and conducts hearings to resolve disputes.
  3. Issues orders for refunds, replacements, or compensation.
  4. Ensures compliance with consumer protection laws and regulations.

Procedure for Filing a Complaint

  1. Prepare the Complaint: Include details such as name, address, description of the dispute, and supporting documents.
  2. Submit to the District Forum: Complaints can be filed physically or electronically.
  3. Payment of Fees: A nominal fee is required, based on the claim amount.
  4. Hearing & Resolution:
    • The District Forum examines the complaint and allows the opposite party to respond.
    • A decision is generally made within 3 months (or 5 months if product testing is required).

Appeal Process

  • If dissatisfied with the District Forum’s decision, the consumer can appeal to the State Consumer Disputes Redressal Commission (SCDRC) within 45 days.

Powers of District Forum

  • Order refunds, replacements, or repairs.
  • Compensate for losses due to defective goods or deficient services.
  • Impose penalties for unfair trade practices and misleading advertisements.
  • Ban hazardous goods and services.
