State Commission and National Commission (Under Consumer Protection Act, 2019)
1. State Consumer Disputes Redressal Commission (SCDRC) – State Commission
The State Consumer Disputes Redressal Commission (SCDRC), also known as the State Commission, is the second level of consumer dispute resolution under the Consumer Protection Act, 2019. It handles appeals from the District Forum and fresh complaints involving higher claim amounts.
Composition of State Commission
- President: A High Court Judge (serving or retired).
- At least four members, including one woman.
Jurisdiction of State Commission
- Monetary Jurisdiction: Cases where the claim amount is between ₹1 crore and ₹10 crores.
- Appellate Jurisdiction: Hears appeals against the decisions of the District Commission.
- Territorial Jurisdiction: Covers the entire state where the complaint is filed.
Functions of State Commission
- Accepts consumer complaints and appeals from District Forums.
- Reviews evidence and conducts hearings.
- Issues orders for refunds, compensation, and corrective actions.
- Monitors compliance with consumer laws and regulations.
Appeal Process
- If dissatisfied with the State Commission’s decision, the consumer can appeal to the National Consumer Disputes Redressal Commission (NCDRC) within 30 days.
2. National Consumer Disputes Redressal Commission (NCDRC) – National Commission
The National Consumer Disputes Redressal Commission (NCDRC), also known as the National Commission, is the highest level of consumer dispute resolution in India. It deals with appeals from State Commissions and high-value consumer cases.
Composition of National Commission
- President: A Supreme Court Judge (serving or retired).
- At least four members, including one woman.
Jurisdiction of National Commission
- Monetary Jurisdiction: Cases where the claim amount exceeds ₹10 crores.
- Appellate Jurisdiction: Hears appeals against State Commission decisions.
- Territorial Jurisdiction: Covers the entire country.
Functions of National Commission
- Accepts consumer complaints and appeals from State Commissions.
- Reviews evidence and conducts hearings at the national level.
- Ensures uniform implementation of consumer protection laws.
- Issues orders for refunds, compensation, penalties, and corrective measures.
Appeal Process
- If dissatisfied with the National Commission’s decision, the consumer can appeal to the Supreme Court within 30 days.
Powers of State & National Commissions
- Order refunds, replacements, and repairs.
- Impose penalties for misleading advertisements and unfair trade practices.
- Ban hazardous goods and services.
- Monitor and enforce consumer rights.
